    The DPDP Act has no size threshold. A single-centre tuition class and a national chain carry the same duties.

    Lead forms need age checks and noticesSections 5, 6 and 9

    Does the education exemption cover coaching?

    The Rules exempt educational institutions from parental consent for educational activities and child safety. Whether a coaching institute counts as an educational institution for this is not settled. Plan as if marketing, results in ads and partner sharing all need a parent’s verified consent.

    Does the DPDP Act apply to small coaching centres?

    Yes. There is no size threshold. If you hold students’ or parents’ personal data digitally, including on a phone or in WhatsApp, you are a data fiduciary.

    Can we use toppers’ photos and ranks in our ads?

    Only with consent for that purpose. For students under 18, that means a parent’s verifiable consent. Keep the proof and remove the ad if consent is withdrawn.

    Can counsellors call leads who filled a form?

    Yes, for the purpose they asked about, if the form gave a clear notice. For under-18 leads, get a parent’s verified consent first. Stop as soon as they withdraw.

    Can we run retargeting ads to students?

    Targeted advertising directed at children is prohibited under Section 9(3). Keep ad pixels and retargeting off for users you know or suspect are under 18.

    How long can we keep lead data?

    Only as long as the purpose needs it. A lead who did not enrol this season should be deleted after a reasonable follow-up period you define and publish.
